    Frequently Asked Questions

What is the Form 23 Certificate of Barrier Compliance in VIC?

A Certificate of Barrier Compliance is the official document confirming your pool or spa safety barrier meets the applicable Victorian standard.

A Pool Inspector issues this after a compliant onsite inspection, and it is then lodged with your local council.

This is the legal proof your barrier is compliant under the Building Regulations 2018.

Who can issue a Certificate of Barrier Compliance in VIC?

Only registered building surveyors, building inspectors or Building Inspectors (Pool Safety) can issue a Form 23 Certificate ofr Barrier Compliance.

A builder, plumber or landlord cannot issue this Certificate.

How often do I need a Certificate of Barrier Compliance VIC?
    Every 4 years.
Once your certificate is lodged, you will be notifiied of the renewal date
The four-year cycle is mandatory for all registered pools and spas across Victoria.
Do I have to register my swimming pool or spa with Council first?

Yes. Registration with your local council is mandatory before lodging a compliance certificate.

Each council keeps a register of pools and spas in its area, and uses your registration to confirm the construction date – which determines the safety standard your barrier must meet.

How To Register Your Pool In VIC

All the step-by-step instructions to register your pool with council – and avoid the fines. Read here> How To Register Your Pool in VIC.

What safety standard does my pool or spa barrier need to meet?

The standard depends on when your pool or spa was built – Council determines this from the construction date.

    As a guide

    Construction dateApplicable standard
    Before 8 April 1991Building Regs 2018, Part 9A
    8 Apr 1991 – 30 Jun 1994AS 1926.1-1986 (Amdt 1, 1987)
    1 Jul 1994 – 30 Apr 2010AS 1926.1-1993
    1 May 2010 – 30 Apr 2013AS 1926.1-2007 (Amdt 1)
    On or after 1 May 2013AS 1926.1-2012

Always confirm the applicable standard with your Pool Registration Certificate from Council before Inspection.

How can I prepare for my pool Inspection?

You don’t need to do anything complicated with a little preparation to help the inspection run smoothly.

Before Inspection, make sure the pool area is accessible with clear access to the pool fence, gates and barriers so the Inspector completes the Inspection without delays.

    • Check gates and latches are working and do not self-close. Pool gates should open away from the pool, close by themselves and latch properly every time.

    • Remove climbable objects near the pool fence, such as trees, pot plants, chairs, BBQ, clothes lines or pool equipment near the barrier.

    • Check pool fence height is less than 1200mm or boundary fence height is less than 1800mm

    • Look for loose panels, gaps, damaged fencing or broken gate latches and hinges
    • Distance between the vertical elements of a fence is greater than 100mm
    • Distance below the bottom of the fence is greater than 100mm
    • CPR Cardiopulmonary Resuscitation sign is missing, incorrectly located or out of date

Collect your property details such as the property address, owner details and pool registration certificate (where required).

What are the reasons my pool barrier can fail the Inspection?
These are the reasons why your pool barrier can fail the Inspection
    • Gate hinges and/or latches are faulty or do not self-close
    • Climbable objects are too close to a pool fence, such as trees, plant pots, BBQs and clothes lines
    • Pool fence height is less than 1200mm or boundary fence height is less than 1800mm
    • Distance between the vertical elements of a fence is greater than 100mm
    • Distance below the bottom of the fence is greater than 100mm
    • CPR Cardiopulmonary Resuscitation sign is missing, incorrectly located or out of date
What happens if my pool barrier fails the Inspection?

That’s ok. Pools are frequently not compliant.

If a Pool Safety Inspector finds a pool does not meet the swimming pool spa fences and barriers safety requirements, a certificate or notice is issued.

If your pool doesn’t comply, you’ll receive a VIC Certificate of Barrier Non-Compliance from your Inspector with time to rectify them.

Within 7 or 60 days of the inspection (depending on the work involved), the Inspector must issue a Form 23 Certificate of Barrier Compliance Legally, Council requires notification after 67-days after the First Inspection.

Rectifications may require the skills of a contractor builder. Be sure to pick the right builder who gets the job right the first time and saves you from spending money unnecessarily.

The best questions to ask your builder are

Do you know pool safety compliance?
I’m in NSW or VIC: what standard do I comply to?
Do you know how to do the rectification works to meet pool safety compliance?

You’ll have time to complete repairs before Booking a Reinspection.

How much does a Certificate of Barrier Compliance cost in VIC?

The price for an Inspection depends on your needs.

Do you know if you are compliant?
Do you know if you are not compliant?

We have packages to suit every need including Free bonus blogs and videos, Free DIY Pool Inspection Checklist and Same-Day Certificates issued the same day as the Inspection. Check our pricing >here.

What are the penalties for not having a compliant pool barrier?

Failing to Register, Inspect or Lodge a Certificate leads to fines and penalties.

If a swimming pool or spa barrier or fence is non-compliant and improvement notices are ignored, Council can escalate the matter.

Beyond the penalties, a compliant barrier prevents children aged 0-5 drowning in backyard pools.

Can I still sell my home if my pool isn’t compliant?

In VIC, your pool barriers and fence need to be compliant at sale. Your Certificate of Barrier Compliance needs to be renewed every 4 years.
