Since 2015, Queensland pool safety laws have required all residential and rental properties with a swimming pool or spa to hold a valid pool safety certification, confirming compliance with the QDC MP 3.4 pool safety standard.

Accepted forms of certification include:

• Form 23 Pool Safety Certificate QLD (issued when compliant)

• Form 26 Non-Conformity Notice (issued when not compliant)

• Relevant Occupation Certificate for newly constructed pools

What Is The Mandatory Part 3.4?

The Queensland Development Code (QDC) MP 3.4 is the mandatory pool safety standard designed to protect young children from drowning incidents. All QLD pool fences, barriers, and gates must comply with this standard to ensure pools are safely enclosed and access is properly restricted.

Who Does The MP3.4 Apply To?

The MP 3.4 pool safety laws apply to all Queensland pool owners, landlords, and property managers. Under these regulations, they must:

• Register their pool or spa on the QLD Swimming Pool Register

• Ensure a valid Form 23 Pool Safety Certificate QLD is held when a property with a pool is sold or leased

• Maintain child-resistant safety barriers separating the pool from residential buildings and neighbouring properties

• Use self-closing and self-latching gates or doors to restrict unsupervised access

• Construct, install, and maintain fences that meet Australian Standards (AS1926.1–2012)

• Display mandatory pool signage, including an up-to-date CPR sign or a “pool under construction” sign, fixed permanently near the pool area

Local councils are responsible for enforcing pool safety compliance. Non-compliance can result in on-the-spot fines up to $235.60 or penalties up to $2,356 for homeowners who fail to meet QLD pool safety inspection requirements.

When Do You Need A QLD Pool Fence Inspection?

In Queensland, you need a pool fence inspection when

• selling or leasing a property located in QLD with a swimming pool or spa
• building a new swimming pool or spa on a property located in QLD
• new fence is being built around an existing swimming pool or spa located in QLD
• a property located in QLD with a pool or spa has been bought 90 days from settlement
• running a family day care, home care or at-home child care facility located in QLD
• requested by your bank applying for or refinancing your home loan, or
• directed by council

QLD pool safety certificates need to be renewed every 2 years.
